Litigation Funding for General Counsel & Legal Teams

For general counsel, litigation funding is a legal-operations tool. It lets the department pursue meritorious affirmative claims without consuming the defence budget, adds an independent underwriting check on merits, and supplies managed execution bandwidth, while counsel independence and settlement control stay with the claimant.

The legal-operations case

Pursue affirmative claims without raiding the defence budget

For general counsel, litigation funding is a legal-operations tool: it lets the department pursue meritorious affirmative claims without consuming the defence budget, adds an independent underwriting check on merits, and supplies managed execution bandwidth, while counsel independence and settlement control stay with the claimant.

Defence budget protected

Affirmative claims are funded under the funding arrangement, so they stop competing with defence work and panel-counsel spend.

Independent merits check

A funder only commits where it believes the claim will recover. That underwriting gives you a second, independent view on merits and recoverability.

Managed execution bandwidth

Asset tracing, attachment and enforcement follow-up are coordinated for you, so a won claim does not stall in an overstretched legal team.

Independence and control

Who decides what in a funded claim

The decisions a general counsel cares about most stay where they are. The funding agreement records this in writing.

How it works

A process that fits how legal teams work

We assess merits, enforceability and recovery prospects. Initial view within 48 hours of the documents.

3

Written funding terms

Costs covered, our share on success and the non-recourse terms, for review by you and your counsel.

4

Funded pursuit, you in control

Your counsel runs the case. You keep settlement control. We coordinate execution and keep you informed.

General counsel questions

Litigation funding for legal teams: FAQs

Does a funder compromise counsel independence?

It should not. The claimant chooses and instructs its own counsel, and strategy decisions stay with the claimant and its lawyers. The funding agreement should say so expressly, and your outside counsel should review it.

Who controls settlement?

The claimant. You decide whether, when and on what terms to settle. LegalFund’s share is set out in the agreement and applies to whatever is recovered.

What do we share with the funder, and is it confidential?

We need enough material to assess merits and recoverability. Information is covered by a confidentiality undertaking. How to structure disclosures to protect privilege should be agreed with your outside counsel.

How is this different from our legal budget?

Funded affirmative claims do not draw on the defence or panel-counsel budget. Under non-recourse terms the funded costs are not repaid if there is no recovery, and LegalFund is paid from an agreed share of any recovery.

Which claims can we refer?

Strong affirmative claims of ₹1 crore and above: decree and award execution, commercial disputes, breach of contract, MSME dues and professional negligence. For commercial litigation we deploy up to ₹5 crore of capital per matter, as stated on our commercial litigation funding page.

Do we need internal approvals to use funding?

That depends on your company’s policies and delegation of authority. Many legal teams involve finance and the board for high-value matters. We can provide a short written summary of terms to support that process.
