INTRODUCTION

The Platform LegalFund has been introduced LegalFund itself a Private Limited Firm having its office at 514 Usha Kiran Building, Azadpur, New Delhi-110033, India (hereinafter referred to as “Owner”, “We”, “LegalFund” or “Us”) to facilitate litigation financing service in which Legalfund provide funds to the claimants to make their claim.

The brand name LEGALFUND and the website www.legalfund.in Visitor or Customer or investors who use the said website/link/application/platform are known as User (hereinafter referred to as “You”, Clients ”)

All Users are requested to read and understand the Policy very carefully before using or accessing the Platform. Through this Policy, we want to explain the method of how we use the data/information of Users collected and used by the LegalFund at the time of providing the service and in the future. This Policy is binding on every User/s of the Platform and Users/ who do not agree with the terms of this Policy should not use or access the Website/link /application.

LegalFund with or without prior notice can change, modify alter, revise, amend, or surrogate this policy. LegalFund reserves its right to change, edit, alter, amend, modify, review, revise or substitute this Policy with or without notice. By using the Website/link/application, the User/s’ signify they have carefully read, understood and agree to be bound by this Policy and the User expressly and voluntarily accept this Policy including any change, modification or substitution made to the Policy from time to time. LegalFund reserves its right to refuse services to any User/s who does not accept or violate the terms of this Policy.

You the user are being authorized to use the LegalFund website/link/application/platform (hereinafter referred to as “Platform”) as per terms and conditions set out in the present draft. By accessing, browsing, or otherwise using the platform/platform will be construed as your unequivocal and irrevocable acceptance and acknowledgement of the terms and conditions and policies thereof. 

Before using the platform, you the user must read the terms and conditions of the agreement/draft. If you start using our platform then we will presume/understand that you have read the term and conditions established by us well and have given your consent to it. LegalFund can allow or disallow the user to access the platform. We also reserve the right to change any of the terms and conditions contained herein at any point in time. LegalFund reserves the right to refuse access to the uses of the services offered at the platform to new users or to terminate access granted to existing User/ at any point in time without assigning any reasons for doing so.

This privacy together with the terms of use describes LegalFund’s policies and procedures on the collection, use and disclosure of the information provided by Users of the Platforms. LegalFund shall not use the User/s information in any manner except as provided under this Privacy Policy. Every User who accesses or uses the Platforms shall be bound by this Privacy Policy.

PERSONAL INFORMATION OF USER/s 

‘We seek personal information like name, email address, residential address, phone number, photograph and other information from the user when they intend to use platform, the only purpose to seek said personal information from the User/s to provide a better experience, new service, new feature /from the platform. That the User/s is free to deny the request by the Platform of the User/s information. If any User/s used an account on behalf of any corporate entity, association, trust or other entity, the User/s should be held liable for the authorization of the same.

Furthermore, LegalFund receives, scrutinizes and stores User/s Information for security and technical reasons such as IP address, login id, email address, password, devise connection information transaction history, date, time and duration of the session on the Platform.

Through automatic methods, the LegalFund receives the URL of the site, an IP address of the User/s’s computer and the type of web browser a User/s is using, email patterns, etc. of the User/s.

The User/s Information is used by LegalFund for other purposes also like to respond to the User/s’ queries, requests and inquiries, update new features of the Platform, improve and customize the Platform’s service, detect and prevent fraud and abuse of the Platform, examine the identity of the users and administer the Platform, inform any change in the Terms of Use or this Policy or the Terms and Conditions of Sale, send surveys and marketing communications that LegalFund may be of interest to the User/s, personalize the user’s experience on the Platform by presenting advertising, products and services tailored for the User/s, help the User/s address its problems with the Platform including addressing any technical problems, complete and fulfil the User/s experience, process payments, communicate with the user regarding our services and provide the user with related customer service and protect the integrity of the Platform. LegalFund can use or share the information of your case details and some matrix and other information (which is publically available)

DISCLOSER OF THE USER/s INFORMATION

User/s Information may be disclosed if required to do so by law or in the good faith and belief that such disclosure is reasonably necessary to respond to notices, court orders, or another legal process.

The user’s information may disclose to law enforcement officers, third party rights owners, or others that are in its opinion reasonably necessary to enforce the Website’s Terms of Use, this policy and Terms and Conditions of Sale. LegalFund does not sell the User/s information in any manner, except as mentioned in the term and conditions and this Policy and for this purpose, we seek the consent of the User/s. LegalFund understands the importance of the User/s information or data so the User/s information is only used and disclosed for providing better and smooth service. That LegalFund may send promotional/offer mail direct to his account but the User/s has the option to unsubscribe if he does not want to receive the email or other communication for LegalFund.

LegalFund is authorized to disclose Personal data of visitors, customers or former customers and to the team processing your ligation fund, data processor, and financing team. In sharing your personal data with any third party, we will do our best effort to protect your information and not to misuse your information in any manner. 

SECURITY

LegalFund is committed to taking all vital steps to protect and deny any unethical and illegal access of the User/s information.

It is a matter of fact that it is impossible to reduce the security risks in the platform 100%. Although, LegalFund may conduct a security review from time to time and also may use any software or instruments to maintain security. After all vital sects for security from LegalFund, we cannot assure the User/s of the security and in the case of any unauthorized access on the platform LegalFund, it shall not be held liable for the same.

USER RESTRICTION:

That at the time of creating an account or taking service on the platform, LegalFund provided an identification code, password or any other important information as a security measure of the platform and User/s information, the User/s should treat such information as very confidential information/data and, the User/s should not disclose it to any third party including to other User/s

That, it is the User/s responsibility to prevent third party’s access to the Platform and he should take some preventive measures to like; sign out from the User/s account after availing the services through the Platform, does not share any confidential information to the third party. 

LegalFund has the right to disable password or code at any point in time if the User/s failed to comply with any term of use and policy. The User/s is solely responsible for the activities that occur under the User/s’ account including the confidentiality of the User/s’ password and LegalFund is not responsible for the same. While using and accessing the Platform, the User/s is responsible for maintaining the confidentiality of the User/s’ account in all manner.

THIRD-PARTY WEBSITES AND LINKS

LegalFund may provide or be linked with other websites for advertisements and LegalFund is not responsible for the privacy practices or content of such websites. That the party website/link may or may not be in control of LegalFund and LegalFund declare that he shall not be responsible or accountable with the content of the third-party website or link in any manner. The User/s should read the privacy policy of every linked website and any access or use of the linked websites is entirely at the User/s’ own risk. LegalFund is not responsible for any direct, indirect, solicited or unsolicited communication made by any of these linked third-party websites/link/application or advertisers or their respective agents. The third-party platform and advertiser may use various technologies to receive the User/s’ IP address and personal information but LegalFund does not have any control over the cookies or technologies that advertisers or websites may use and the User/s should contact them directly for more information about their privacy practices and policies. Based on the User/s Information including the nature of products/ services taken by the User/s through the Website, LegalFund may display its future plans, new services related advertisements on the Platform when User/s clicks on the advertisement link.

GENERAL TERMS

That the platform Policy shall read in concurrence with Platform’s Terms of Use and Terms and Conditions of Sale.

The User/s Information resides in LegalFund’ database for a certain period of time even after the User/s ceases to use or access the Platform and in such cases, LegalFund is not liable for any usage of the User/s Information after the User ceases to use or access the Platform.

The User/ agree and acknowledge that User/s Information collected through the Platform could be stored and processed in any other country across the world. The User acknowledges that for effective provision of the Platform’s services in respective territories including territories outside India, the User/s Information may be stored or processed by trusted third parties. Whenever the User/s Information is shared with trusted third parties in countries outside India, LegalFund endeavours that the User/s Information is transferred under the applicable laws of India.

The User/s should be aware that the User/s Information or other data that the User/s provides to the Platform for availing the services or transacting through the Platform could be read, collected, or used by other User/ or third parties in such a case the User/s Information might be used for sending unsolicited messages or communications for which LegalFund is not responsible.

The User/s agrees and acknowledges LegalFund’ right to utilize the User/s’ posts, contents, information and other personal data for the purpose of providing services through the Platform. The contents on the Platform may contain comments, posts and reviews posted by the User/ which may be public and searchable on the internet in such a case the User/s’ comments, post reviews and information and personal data provided to the Platform may be viewed by other User/ and LegalFund cannot guarantee that other User/ or third parties have not made copies of or used the ideas and information that the User/s has shared on the Platform.

 PAYMENT

All payments that you make for services and investing proposed on the Platform are direct to the LegalFund, you are advised to read the terms of use of such payment service providers prior to using their services and the Platform will not be responsible nor assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to: Lack of authorization for any Transactions, or any payment issues arising out of the Transaction, or Decline of transaction for any other reason.

Further, Transactions, product or services prices and all commercial terms are as per principal to bipartite contractual obligations between Users for Transactions.

INDEMNITY

The user agrees to indemnify harm to each other and put LegalFund and its executive, partners, shareholders, employees out of the purview. 

Further, the LegalFund is also out of the purview of all actions, proceedings, claims, losses, damages and costs (including attorney fees) and other expenses suffered or incurred due to or attributable to or arising out of (i) violation of any applicable law (ii) breach of any representations, warranties or covenants of the User (iii) breach of the policies, guidelines and conditions of LegalFund or Additional Terms or these Terms or Privacy Policy (including any modifications or additional notifications or instructions); (iv) infringement of any third party rights. This Clause survives after the termination of the present agreement.

GOVERNING LAW AND JURISDICTION

The terms and conditions of this Policy shall be governed by Indian Law and the courts in Delhi shall only have exclusive jurisdiction to resolve any disputes.
