Litigation Funding for CEOs & Promoters

For a CEO or promoter, an unresolved high-value claim is a strategic asset decision: write it off, settle it, or pursue it. The rational answer depends on recoverability, not on how uncomfortable litigation feels. Funding removes the cash objection. Assessment answers the recoverability question.

The promoter’s decision

An unresolved claim is a decision waiting to be made

For a CEO or promoter, an unresolved high-value claim is a strategic asset decision: write it off, settle it, or pursue it. The rational answer depends on recoverability, whether the claim can practically convert to cash, not on how uncomfortable litigation feels.

Option 1

Write it off

Accept the loss and move on.

  • Rational when assets cannot be traced or the debtor is unreachable
  • Costly when the claim was actually recoverable
Option 2

Settle it

Take a negotiated amount now.

  • Rational when the price reflects real recoverability
  • Weak when you settle low only because you cannot afford to fight
Option 3

Pursue it, funded

Fight or enforce with the costs covered under the funding arrangement.

  • Repayment is contingent on recovery
  • You negotiate from strength, not from cash pressure

Two separate questions

Funding removes the cash objection. Assessment answers recoverability.

Most promoters mix the two. We keep them apart, so you decide on facts.

What funding solves

The “I cannot put more money into this” objection.

  • Legal and enforcement costs covered under the funding arrangement
  • Non-recourse: funded costs not repaid if there is no recovery
  • Your cash and capital stay in the business

What assessment answers

The “will we actually see the money?” question.

  • Are the opposite party’s assets identifiable and reachable?
  • Is the claim enforceable and within time?
  • Are the documents strong enough to carry it?
  • How long to realistic cash conversion?

Why promoters choose funded recovery

Decide from strength, not from cash pressure

Capital protected

Company and personal capital are not exposed to litigation costs on a claim that may or may not recover.

Better settlement leverage

When the other side knows you can fund the fight, a low-ball settlement offer loses its pressure.

Your time stays on the business

Enforcement work is carried by counsel and our team, so it does not take over your calendar.

Confidential review

Your claim file is reviewed confidentially before any commitment on either side.

Promoter questions

Litigation funding for CEOs and promoters: FAQs

Should I write off, settle or pursue my claim?

It depends on recoverability: whether the claim can practically convert to cash. If assets can be traced and the claim is enforceable, pursuing it may beat both a write-off and a low settlement. If not, settling or stepping back can be the rational choice. An assessment answers this before you commit.

Does funding mean I must pursue the claim?

No. Funding only removes the cash objection. The assessment comes first, and you decide whether to pursue, settle or stop based on the findings.

What does non-recourse mean for me personally?

If the claim does not recover, you do not repay the funded costs. If it does, LegalFund is paid from an agreed share of the recovery, set out in writing before we start.

Can funding help me settle on better terms?

It can. A claimant who can fund the case is not forced to accept a discount just to avoid legal costs, which usually strengthens the negotiating position.

What size of claim do you fund?

We focus on strong claims of ₹1 crore and above. For commercial litigation we deploy up to ₹5 crore of capital per matter, as stated on our commercial litigation funding page.

Who stays in control of the case?

You remain the client and keep your own counsel. We fund the case and stay informed, and strategy decisions stay with you and your lawyers.
