For Law Firms & Advocates

Litigation Funding for Law Firms & Advocates

When a client has a strong claim but cannot fund the pursuit, the matter dies and the firm loses the brief. Third-party funding changes that. LegalFund contracts with the claimant, funds the litigation for eligible matters, and counsel are paid brief fees in the ordinary course, independence intact, conduct rules respected, no fee-sharing.

The brief that should not be lost

A strong claim should not die for want of funding

When a client has a strong claim but cannot fund the pursuit, the matter dies and the firm loses the brief. Third-party funding changes that.

Without funding

The matter stalls

  • Client cannot pay for a long-running pursuit
  • A strong claim is dropped or settled cheaply
  • The firm loses the brief and the relationship
With LegalFund

The matter proceeds

  • We contract with the claimant and fund eligible matters
  • You are paid brief fees in the ordinary course
  • You keep the brief, the client and your independence

We contract with the claimant

The funding agreement is between LegalFund and your client. You remain counsel to the client, not to the funder.

Brief fees in the ordinary course

Your fees are not contingent on the outcome and are not shared with us. They are paid as they fall due under the funded costs.

Independence intact

Strategy, drafting and settlement advice stay with you and your client. The funder does not instruct counsel.

Conduct rules respected, no fee-sharing

There is no fee-sharing and no referral payment to counsel. The arrangement is built to sit within the professional conduct rules.

    Counsel questions

    Litigation funding for advocates: FAQs

Who is the funder’s contract with?

With the claimant, your client. LegalFund does not contract with counsel for the conduct of the case. You remain counsel to your client.

How and when am I paid?

Brief fees are paid in the ordinary course, not contingent on the outcome. The funded costs cover them as they fall due under the arrangement.

Is there any fee-sharing or referral fee?

No. There is no fee-sharing and no referral payment to counsel.

Does the funder instruct me or control settlement?

No. Counsel’s independence stays intact. Strategy and settlement decisions are for the claimant on your advice. The funding agreement records this in writing.

Is third-party funding consistent with the professional conduct rules?

The arrangement is designed so that counsel’s duties are unchanged: no fee-sharing, no contingent fee for counsel, and no control by the funder. Check the position with your Bar Council rules and your own judgment before you proceed.

Can I refer a matter without breaching client confidentiality?

Take your client’s consent first, and share only what is needed for a first review. A confidentiality undertaking can be put in place before documents are exchanged.

What size of matter do you fund?

We focus on strong claims of ₹1 crore and above. For commercial litigation we deploy up to ₹5 crore of capital per matter, as stated on our commercial litigation funding page.
