Why a family office is different

One dispute, four pressures at once

For a family office, litigation touches liquidity, reputation, succession and family governance at once. LegalFund treats disputed value as a legal asset: assessed on recoverability, funded so pursuit does not distort family liquidity, and executed with the discretion and reporting a family board expects.

Liquidity

Legal and enforcement costs are covered under the funding arrangement, so pursuit does not pull cash from investments, operations or family needs.

Reputation

Assessment is confidential, and the matter is handled by a small team on a need-to-know basis.

Succession

A disputed asset can complicate transitions between generations. Treating it as a legal asset with a clear plan keeps it from becoming a family problem.

Family governance

Decisions follow your governance: reporting is structured for the family board, trustees or investment committee, not buried in legal updates.

Disputed value as a legal asset

Assessed on recoverability before anything is committed

1. Merits

Is there a clear right and a clear loss?

  • Title, contract or decree behind the claim
  • Defences and limitation position
  • Quantum of the disputed value

2. Recoverability

Can a win become cash or secured value?

  • Counterparty assets and solvency
  • Enforceability of an order or award
  • Security or charges already held

3. Time to value

How long, and at what total cost?

  • Realistic path and forum
  • Expected duration
  • Funding needed end to end

Design how the matter will be run and reported

1. What type of claim?

2. Who holds the claim?

3. How sensitive is it?

    Family office questions

Litigation funding for family offices and HNIs: FAQs

    How is confidentiality handled?

Assessment is confidential and limited to the people who need the information. A confidentiality undertaking can be agreed before documents are shared. Share only what is needed at each stage, and agree the approach with your counsel.

    Does funding affect our liquidity?

For eligible claims, legal and enforcement costs are covered under the funding arrangement, so pursuit does not draw on family liquidity. Under non-recourse terms the funded costs are not repaid if there is no recovery. LegalFund is paid from an agreed share of any recovery.

Can we choose our own lawyers?

Yes. You remain the claimant and instruct your own counsel. Strategy and settlement decisions stay with you.

What reporting will our family board receive?

Reporting is agreed up front: frequency, recipients and format. You can choose quarterly, monthly or milestone-based updates for the family board, principal, trustees or office team.

Can the claim be held through a trust or a company?

Often, yes. The right structure depends on the claim, tax and succession planning, so settle it with your lawyers and advisers before engagement.

What size of claim do you fund?

We focus on strong claims of ₹1 crore and above.
